The Scuttlebutt Featuring Articles About Pot Co. Faked Email To Dodge $6M Payment, The Cannabis Industry Paid $1.8B in Excise Tax and More

In the days of the Armada, a fleet of warships, the scuttlebutt was the rumor or gossip that would spread throughout the ship. Today, Armada Law Corp presents The Scuttlebutt, a daily summery of news articles that people within the cannabis, hemp and plant medicine industries are chatting about along with links to the full articles.

In today’s news:

#psychedelics – “People who use psychedelic drugs for entheogenic purposes tend to also have heightened spiritual development, according to new research published in the Journal of Psychedelic Studies. The new findings provide insight into how entheogenic drug use is related to spirituality and psychological well-being.

The term “entheogenic” refers to substances, plants, or practices that can induce altered states of consciousness, spiritual experiences, or mystical insights. The word “entheogenic” is derived from the Greek word “entheos,” which means “god within,” and “genesthai,” which means “to generate.””

#cannabislaw – “Culta LLC owner Mackie Barch claimed there just weren’t any buyers or investors interested in his Baltimore-based cannabis wholesale dispensary, and he confirmed that with an email from the financial firm he contracted to make the deal happen.
But that turned out not to be true, said plaintiff David Joshua Bartch, the defendant’s former partner who is owed millions of dollars, Bartch told the court on Tuesday in his motion seeking sanctions.
The email was altered to suggest that no one was interested, so Barch could attempt to use his company to secure capital. In fact, he may already have, the plaintiff said.”

#cannabislaw – “In an order filed Tuesday, U.S. District Judge Linda V. Parker dismissed without prejudice HP Sanford LLC’s suit, while also denying its bid for an injunction blocking the city from issuing the permit to Sue LaBonville, who is not a party in the suit.
According to the suit, the village enacted two ordinances that took effect in April 2022 establishing a district for cannabis retailers and establishing the permitting procedure in which applications would be heard on a first-come, first-served basis.
LaBonville submitted her permit application in April 2022, while HP Sanford submitted its application May 10 — only for the village to respond that the application was incomplete because it did not include an electronic copy.
HP Sanford’s resubmitted application was also denied, with the village saying it was missing required information, while LaBonville’s application was approved, according to the suit.”

#cannabisindustry – “On September 18, 2022, California amended its primary employment discrimination law to specifically regulate the drug testing methodologies that employers may use when making hiring, termination, and other employment decisions relating to cannabis users. More recently, on May 9, 2023, Washington Governor Jay Inslee signed similar legislation relating to initial hiring decisions. Both laws, which will be effective January 1, 2024, are the first of their kind because they require employers to have a basic understanding of a somewhat complicated issue – the science behind cannabis testing.”

#cannabisindustry – “If you pour the stress of 280E on top of other cannabis business hurdles, such as difficulty accessing banking services and regulations against any interstate commerce, the result is that for many companies, it’s impossible to make a profit in the legal cannabis biz. The effective tax rates are often higher than 70% for cannabis retailers.”

#cannabislaw – “A Colorado cannabis business has filed a lawsuit in state court accusing its former general counsel of conspiring with company insiders to force out the CEO by making false claims about him, alleging damages “believed to be in the millions of dollars.”
The suit, filed Wednesday by Nobo Inc., says Roxane Peyser breached her fiduciary duty as a lawyer by publishing a memo based on “false or unsubstantiated allegations” and worked with board members to remove CEO Alan Bonsett.”

#cannabislaw – “In a response brief filed Tuesday, Consulting by AR LLC said Ignite Spirits Inc.’s motion for reconsideration of the judgment doesn’t say how the judgment was wrong or that there were errors in law, but rather brings up “irrelevant” and “unconvincing” arguments, many of which were already rejected.
“Like a petulant child, Ignite Spirits and Ignite Brands’ ploy is to keep asking over and over for the same thing and hoping for a different result,” Consulting by AR wrote. “But they have failed miserably to satisfy their burden justifying any post-judgment relief.””
