THE SCUTTLEBUTT FEATURING ARTICLES ABOUT NEW YORK COMMERCIAL LANDLORDS FACE DILEMMAS IN LEASING TO CANNABIS OPERATORS, CONNECTICUT EXPUNGES MORE THAN 43,000 CANNABIS CONVICTIONS, ILLINOIS INTRODUCES PSYCHEDELICS LEGISLATION AND MORE

In the days of the Armada, a fleet of warships, the scuttlebutt was the rumor or gossip that would spread throughout the ship. Today, Armada Law Corp presents The Scuttlebutt, a daily summery of news articles that people within the cannabis, hemp and plant medicine industries are chatting about along with links to the full articles.

In today’s news:

#californiacannabis – “The historic storms pummeling California have caused widespread fallout for cannabis operators across the state and are disrupting operations and possibly supplies.

As days of high winds and catastrophic rains batter the coast, some marijuana companies have temporarily closed operations and shored up their facilities in a desperate attempt to lessen the damage.”

#hempderivedproducts – “A new study published in the Journal of Medical Toxicology raises safety concerns about the inhalation of THC-O acetate. THC-O acetate, commonly known as THC-O, is a potent intoxicating cannabinoid that is produced following the chemical synthesis of hemp-derived CBD. The product is becoming increasingly marketed  on the internet and in unlicensed stores.

The study’s authors caution that THC-O shares structural similarities with Vitamin-E acetate, an additive in unlicensed THC vape cartridges that was previously linked to the 2019-20 outbreak of EVALI lung disease. (The EVALI breakout resulted in several thousand cases nationwide, including more than 60 fatalities.) Authors report that, upon heating in a vape pen, both substances produce ketene – a “highly potent lung toxicant” and the suspected cause of EVALI.”

#psychedelics – “In the opening hours of a new legislative session, one Illinois legislator introduced legislation that would establish a regulated psychedelic therapy program in the state.

Democrat La Shawn Ford introduced the Compassionate Use and Research of Entheogens Act, or the “CURE Act”, as the first piece of legislation for the new members of the chamber.

The legislation, if passed, would create a regulated psychedelic therapy program under the guidance of an advisory committee. The program would allow adults ages 18 and older to legally seek psychedelic therapy from a trained facilitator at a licensed service center.”

#cbdproducts – “Congressman James Comer plans to investigate the U.S. Food and Drug Administration (FDA), according to the U.S. Hemp Roundtable (USHR), a coalition of companies and organizations that advocate for hemp-friendly regulations.

The Kentucky representative, who is chairman of the U.S. House Oversight Committee, intends to bring FDA Commissioner Robert Califf before the House committee to discuss critical issues falling within the agency’s regulatory jurisdiction such as hemp-derived CBD and medical devices.

“I want to bring the FDA commissioner in front of the committee, and this is one of the things that we want to talk about,” said Comer. “It’s not just their lack of action with respect to CBD and other types of hemp — it’s their inaction regarding a lot of areas of their jurisdiction.””

#cannabisconvictions – “Connecticut officially launched its legal adult-use cannabis industry this week, along with Clean Slate laws which erased low-level cannabis convictions for nearly 43,000 residents just before legal sales began on Tuesday.”

#californiacannabis – “A California state judge has denied a former sales representative’s bid to seize nearly $381,000 from cannabis company Advanced Nutrients Inc. as part of a suit alleging the company failed to pay him that amount in severance and bonuses, saying he had failed to show he was likely to succeed on his claims.

In the order, issued after a hearing Wednesday, Judge Helen Zukin sustained Advanced Nutrients’ objections to Ryan MacDhubhain’s petition for a writ of attachment, which allows the court to seize certain assets to aid in collection pending the outcome of a trial.”

#californiacannabis – “A Los Angeles County judge has blocked a Southern California municipality from seeking a $220,000 fee from cannabis distributor Rukli Inc., barring the enforcement of any part of a cultivation licensing agreement that ended both a highly controversial cannabis transportation deal and a racketeering lawsuit against the company.

In a two-page order, Superior Court Judge David Sotelo granted Rukli’s motion for preliminary injunction, forbidding Baldwin Park from any further attempts to collect the fee or get in the way of its operations. The company’s lawsuit claims the city breached the agreement.”

#newyorkcannabis – “While lawmakers and policing authorities deal with the growing number of illegal dispensaries, many NYC commercial landlords find themselves dealing with a growing number of lease offers from smoke shops and potential cannabis dispensaries. Additionally, many commercial landlords are dealing with the reality of illegal cannabis sales by smoke shop tenants under current leases. There are several options for commercial landlords facing the prospect of leasing space to a smoke shop or cannabis retailer, with some (especially those hit hardest by the COVID-19 pandemic) taking the “lease now, ask later” approach. This approach raises the greater question regarding the potential liability faced by commercial landlords that lease to unlicensed cannabis enterprises.”
